We have handled transportation-related litigation and arbitration matters, including jury trials, for numerous clients, including airlines, railroads, trucking companies, water carriers, and ports.  In the United States, we have litigated antitrust cases, breach of contract cases, land use cases, merger-related securities cases, a merger-related ERISA case, cases involving title to minerals on land-grant lands, arbitrations involving joint facility agreements, and many more.  We have also handled transportation-related litigation before the European Court of Justice and other European courts.

In addition, our lawyers have litigated matters before a variety of transportation regulatory agencies, including the U.S. Department of Transportation, the Federal Maritime Commission, and the Surface Transportation Board.  Among other matters, we have handled agency proceedings involving mergers, rate complaints, and alleged violations of rules and statutes.  We also handle appeals from decisions of those agencies.

Representative Matters

  • We represent Union Pacific Railroad Company in a multi-district class action litigation alleging price fixing of freight fuel surcharges and in other antitrust litigation alleging price fixing of fuel surcharges in violation of Section 1 of the Sherman Act and other allegations in violation of Section 2 of the Sherman Act.
  • We represent Expeditors International in a class action alleging a price-fixing conspiracy by freight forwarders and in investigations in the United States and Europe.
  • We represent a major international airline in a putative class action alleging a price-fixing conspiracy involving passenger rates and surcharges among transpacific air carriers.
  • We represented American Moving and Storage Association in multidistrict class action litigation alleging price fixing of fuel surcharges by household goods movers.
  • We represented International Air Transport Association in multidistrict class action litigation alleging a price-fixing conspiracy by air cargo transport providers in the United States.
