The firm’s transportation practice reflects an impressive breadth and depth of expertise and experience. We continue to handle in a fully integrated manner a broad range of regulatory, antitrust, litigation and governmental affairs matters cutting across all modes of transportation.
Our lawyers regularly represent transportation clients in a wide array of regulatory matters. We have represented railroad, airline, and maritime interests before the Surface Transportation board (the successor to the Interstate Commerce Commission), the Federal Maritime Commission, and the Department of Transportation. And we have assisted passenger and freight railroads with corporate transactions that involve securing the necessary private financing and regulatory approval.
The firm also regularly represents transportation clients in a wide range of antitrust matters. We have advised on the antitrust dimensions of carrier pricing, marketing practices, inter-carrier agreements, joint ventures between carriers and suppliers or customers, and acquisitions subject to the Hart-Scott-Rodino Act. Our lawyers have handled competition issues in connection with our representation of railroads, airlines, trucking companies, and maritime interests before the Surface Transportation Board, the Department of Justice, and the Department of Transportation.
Our lawyers also have substantial experience with transportation-related litigation and arbitration matters, including jury trials and appeals. In the United States, we have litigated antitrust cases, breach of contract cases, land use cases, merger-related securities cases, a merger-related ERISA case, and arbitrations involving joint facility agreements. We have also handled transportation-related litigation before the European Court of Justice and other European courts.
The transportation practice group has provided a broad range of governmental affairs counsel on a variety of issues as well. It continues to play a lead role in advising the rail industry on regulatory and safety policy and legislation. It also provides ongoing legislative counsel to a major airline, and has advised several clients on the recently passed highway funding legislation.
Linda Morgan, the head of the firm’s Transportation practice group, brings significant expertise to the practice as the former Chairman of the Surface Transportation Board (and the Interstate Commerce Committee before that) and General Counsel of the Senate Committee on Commerce, Science and Transportation. Jack Schenendorf, formerly Chief Counsel for the House Committee on Transportation and Infrastructure, also brings important experience to the practice particularly in the governmental affairs area.
Representative Matters
- We continue to represent Union Pacific Railroad Company in a broad range of regulatory antitrust, and governmental affairs matters.
- The firm has advised United Airlines on the recently approved pension reform legislation and infrastructure issues.
- We counsel the Association of American Railroads on a variety of economic and safety regulatory matters and antitrust issues.
- The firm provided advise to the American Association of State Highway and Transportation Officials and the Association of Contractors on the recently passed highway bill.
- We have provided counsel to a trucking company and to various drug companies in their efforts to ensure compliance with motor carrier safety regulations.
