In the regulatory arena, our practice provides comprehensive representation of telecommunications clients from issues that require significant strategic and legislative effort to daily regulatory compliance issues. In the transactional arena, our commercial lawyers’ experience in the telecommunications industry allows them to understand the unique business issues confronting the industry, both from a provider and customer perspective. The practice also has long been known for its litigation excellence. Our work has included everything from defending and challenging orders of the FCC before federal appellate courts to defending statutory challenges to legislation in trial-level federal courts.

Representative Matters

  • TDS Telecommunications. Covington provides ongoing regulatory advice to TDS, a local telephone company serving over 6 million customers in more than 30 states. Covington provides strategic advice and representation on issues such as intercarrier compensation, universal service, interconnection, and emerging telecommunications technologies with efficient and cost-effective management of more routine regulatory issues.
  • InfoNXX, Inc. Covington advises InfoNXX, the world’s largest wholesale provider of directory assistance services to the wireless industry, in regulatory proceedings, legislative efforts, and corporate transactions designed to facilitate and enhance the company’s ability to provide high-quality, innovative directory assistance and other information services, both in the U.S. and Europe.
  • Fortune 100 national retailer. We represented a Fortune 100 national retailer on procuring telecommunications services, as it negotiated new multi-year contracts with a number of vendors. We similarly have represented entities eligible for FCC funds in negotiating telecommunications contracts.
  • Wiretap compliance/CALEA. Covington advices numerous clients, from carriers to cable companies to software providers to higher education institutions, on issues relating to compliance with the Communications Assistance Law Enforcement Act (CALEA). Covington’s attorneys have been intimately involved with CALEA since its inception (including its drafting) and have represented clients in litigation in the D.C. Circuit.
