  • Defending and ultimately settling class action conspiracy claims against Bank One in the Currency Conversion Fee Antitrust Litigation related to currency exchange as applied to credit and debit card transactions.  Bank One’s settlement contribution was favorably affected by our success in briefing and argument of a motion enforcing arbitration provisions in its cardholder agreements.
  • Representation of Bank of America in the ATM Interchange Antitrust Litigation, a putative nationwide consumer class action challenging interchange fees on ATM transactions.
  • Defense of JPMorgan Chase in litigation brought by American Express alleging that Visa, MasterCard and member banks, including Chase, conspired to enact rules preventing member banks of Visa and MasterCard from issuing credit and debit cards using the Amex network.
  • Defense of JPMorgan Chase against class action claim asserting that the arbitration provisions contained in payment and cardholder agreements are the product of a conspiracy among issuing banks.
  • Briefing and argument of a successful motion to dismiss our client, Bank of America, and other bank defendants from a putative class action challenging credit card interchange fees.
