Covington's team includes a former FERC Commissioner, a senior FERC electricity policy staff member, and a General Counsel of Constellation Energy, each expert on virtually every aspect of pricing, siting, planning and cost allocation for these resources. Covington represents utilities, customers, power producers, and wind and solar companies with respect to smart grid, acquisition of transmission and distribution resources, RTO transmission policy, merchant transmission, grid access, net metering, demand response, grid interconnection, and investment in transmission and distribution technologies and resources.
Representative Matters
- PSEG, a large New Jersey electric utility, with respect to the filing at FERC of a petition seeking financial incentives and certain favorable regulatory treatments for PSEG's construction of five large high-voltage transmission projects that required multiple regulatory approvals. We also advised on the rate incentive applicable to the Northeast Grid Reliability Project, a transmission investment of almost $1 billion, and represented PSEG at FERC on this matter. FERC granted a range of incentives for these transmission projects.
- Major national retail electricity supplier on the rules regarding 3rd party access to distribution resources and the retail market structure required to facilitate robust electricity supply competition in a dozen states including Texas, Pennsylvania, Illinois, Maine, Maryland, New York, Massachusetts and Ohio.
- Pepco Holdings, Inc. and its subsidiaries for over 25 years, including representation in over $6.6 billion of securities offerings since 2002, including mortgage bonds, notes, tax-exempt pollution control bonds and common stock. In addition, Covington has handled for this client syndicated credit facilities, commercial paper programs, bilateral credit agreements, bridge acquisition facilities, a credit intermediation arrangement, and swap transactions.

- RES Americas on electric transmission matters in pending federal energy legislation and on a variety of FERC regulatory issues related to the expansion of the transmission grid.

- SDG&E in connection with a FERC and appellate court proceeding regarding congestion revenue rights in the California ISO.
