In close collaboration with our lawyers involved in energy regulatory matters, we have worked extensively with energy clients on the full range of antitrust issues.  This has included antitrust advice on oil and gas development and marketing, natural gas pipelines and LNG projects, electricity generation and marketing, and electricity restructuring.  Mergers and acquisitions, civil and criminal investigations by federal and state antitrust agencies, and almost a dozen private antitrust suits in the last decade illustrate the breadth of antitrust experience our lawyers bring to clients in this industry.

Representative Matters

  • PPL Corp. in a half-dozen private suits involving wholesale electricity markets in California, the Pacific Northwest, and the mid-Atlantic states.  Motions to dismiss or for summary judgment were granted in each of these states.
  • Representation of a significant electric generator in a state investigation of price spikes in the wholesale electricity and natural gas markets.
  • Antitrust advice to ExxonMobil Corporation regarding various aspects of its Alaskan oil and natural gas operations.
  • Antitrust advice to the American Petroleum Institute on a range of issues. 
  • Representation of Kerr-McGee Corporation, PEPCO, and other energy clients with respect to HSR filings and related substantive antitrust issues in connection with significant transactions.
  • Representation of Union Pacific Railroad in connection with coal supply agreements with electric utilities and various issues related to coal transportation rates.
