We’ve also represented important associations—such as the American Counsel on Education, the Association of American Universities and the College Board—in defending university financial aid policies.

In addition to our substantive expertise, a crucial element of our practice is that our approach to education is cross-disciplinary. Representative Matters

Litigation

  • American Association of University Professors in defending the confidentiality of the Association’s investigatory files in connection with a third party subpoena; and in preparation of an amicus brief on behalf of the Association in support of the proposition that there is a right to academic freedom under the First Amendment.
  • Representation of 12 nonprofit national educational associations, including the American Council on Education, the Association of American Universities, and the College Board, as amici in a successful appeal overturning a lower court ruling that the financial aid policies of MIT and the Ivy League violated antitrust laws.
  • Representation of the American Council on Education on a variety of litigation matters and other issues, including matters related to personal data security, music licensing, copyright, and the tax treatment of the donation of patents to universities.
  • Washington University in a case of first impression in the area of biomedical research.

Regulatory
  • Advice to bigchalk.com on federal privacy law, including the Children’s Online Privacy Protection Act, advertising best practices, software licensing, content licensing, copyright, online distribution and commercial agreements.
