Covington has a leading practice advising clients on national security-related investigations conducted by federal law enforcement agencies and congressional committees. Our lawyers also are expert in the proper handling of classified information and the special confidentiality required of national security-related inquiries. One of our senior lawyers in this area is a former Special Counsel in the White House.
Covington has broad experience representing both individuals and corporations in national security investigations conducted by law enforcement agencies and leading congressional committees. These representations have involved, among other things, a Department of Justice and FBI investigation into the handling and destruction of classified information; an investigation by Congressional committees into management and procurement issues at a leading national security-related national laboratory; a national security investigation by the Transportation Security Administration into administrative processes and regulatory compliance by a leading aviation company; a U.S. attorney’s investigation into a foreign government official’s use of Department of Energy funds; and hearings by Congressional committees on government contracts related to the war in Iraq.
Our lawyers also are well-versed in advising clients on the proper handling of classified information and proper treatment internally of law enforcement and intelligence-related requests for access to information, including the handling of so-called “National Security Letters” and other demands for information under the USA PATRIOT Act. We have assisted clients both in responding to such requests for assistance from U.S. government agencies, and in developing internal policies and practices to govern compliance with the requests.
