Covington has the preeminent regulatory practice involving veterinary pharmaceuticals and biological products, animal feed and pet food.  Covington is the FDA regulatory counsel to most major animal health companies and to a number of clients that manufacture animal feeds or feed ingredients.  Our lawyers advise clients, both large and small, on all aspects of veterinary pharmaceutical and biologics regulation, manufacture, approval and marketing.  We routinely advise feed and feed ingredient manufacturers on the complex, state-centric regulation of animal feeds, supplements and pet food in the US.  Our colleagues in our London and Brussels offices advise clients on the corresponding areas in Europe.  We also routinely defend companies in enforcement actions brought by FDA, USDA and the states.  Additionally, we advise clients on import and export issues for animal products and on compliance with the Animal Welfare Act and its regulations governing animal research.

Covington’s animal food and drug practice dates back to the 1960s and one of our attorneys who specializes in this area hold a Doctorate of Veterinary Medicine as well as a law degree.

Representative Matters

  • Assisted various companies with the import, compliance and recall issues associated with the 2007 melamine contamination of pet food and its aftermath.
  • Advised animal drug manufacturers on the Food and Drug Administration’s authority to regulate inactive ingredients in animal drugs in light of the Delaney “Anticancer” Clause in the Food, Drug, and Cosmetic Act.
  • Assisted a client design, plan, and establish a significant new animal health business.
  • Defended and successfully settled administrative compliance actions brought by the United States Department of Agriculture under the Animal Welfare Act.
  • Successfully represented a coalition of companies in opposing release by a federal agency of certain sensitive information reflected in documents required to be filed with that agency.
  • Handled internal investigations for various clients and the related negotiations with agencies regarding the findings and underlying issues.
