Erin Egan is a partner and co-chair of Covington & Burling's Privacy and Data Security practice group, and was recently recognized by both Chambers USA and Legal 500 US as a leading Privacy and Data Security lawyer.
Ms. Egan regularly counsels multinational companies on a broad range of privacy and security issues, including responding to data security breaches, assessing privacy and data security practices, drafting and revising privacy and information security policies, complying with federal and state regulation of marketing practices, and handling government requests for customer information.
Ms. Egan has represented clients on privacy and data security matters pending before the Federal Trade Commission and various State Attorneys General, and she is deeply involved on behalf of Internet and software companies in legislative and regulatory efforts to address privacy, spam, spyware, identity theft, and other consumer protection issues.
Representative Matters
- Counseling clients on data security breaches, including US and international notification requirements, FTC and state agency investigations and enforcement, outreach to legislators and other government elites, call center response, and media and consumer communications.
- Representing clients before the Federal Trade Commission as to Internet privacy and data security matters, and served as counsel to Microsoft in the FTC’s groundbreaking investigation and agreement related to Microsoft’s Passport Internet authentication service.
- Conducting privacy assessments of online and offline information collection, use, and disclosure practices of multi-national companies, including analysis of data flows, privacy notices, and vendor contracts.
- Advising clients on pending privacy, spyware and data security legislation, including meeting with staff, drafting testimony, and helping craft legislative amendments.
- Counseling clients on a range of e-mail marketing issues under the CAN-SPAM Act and the FTC’s implementing regulations.
