Eric Bosset is a partner whose litigation practice encompasses a broad range of civil matters, specializing in recent years on litigation relating to user privacy and security on the Internet. Mr. Bosset has extensive experience in class actions, multi-district proceedings, and other complex lawsuits. Mr. Bosset has obtained dismissals for numerous defendants prior to trial, and multi-million dollar recoveries for plaintiffs. Representative trial victories include a jury verdict for the defendant in a class action that The National Law Journal ranked among the 25 most notable defense verdicts of the year.
Representative Matters
- Representing Internet Service Provider in privacy-related litigation alleging putative class action claims under the Electronic Communications Privacy Act (“ECPA”), Computer Fraud and Abuse Act (“CFAA”), and Video Privacy Protection Act (“VPPA”). Burns v. AOL, Inc. (D. Mass).
- Represented multi-national software company, media company, and consumer goods companies in a putative class action lawsuit alleging improper use of Internet tracking technologies for advertising purposes. The suit was recently dismissed. Bose, et al. v. Interclick, et al. (S.D.N.Y.)
- Won for Internet Service Provider the dismissal of a putative class action lawsuit asserting claims under the ECPA and CFAA. Green, et al. v. Cable One (N.D. Ala.)
- Won a jury verdict in a class action lawsuit alleging “pattern or practice” employment discrimination. Bush, et al. v. Deere & Company (C.D. Ill.).
- Won on appeal the vacatur of class certification in a “stock drop” lawsuit involving a 401(k) plan. In re: Schering Plough Corporation ERISA Litig., 589 F.3d 585 (3d Cir. 2009).
