Elizabeth Arens is an associate in the firm’s litigation and antitrust & competition law practices.  She has represented clients in federal, state, and arbitration proceedings as well as Department of Justice and Federal Trade Commission investigations.  Ms. Arens has also advised clients on a range of antitrust issues.

Ms. Arens maintains an active pro bono practice, including winning a jury verdict of not guilty for a Covington client after a two-day trial.

Representative Matters

  • Represents a leading electronics company in a multi-district class action antitrust litigation.
  • Represents a venture among US media companies in a DOJ civil inquiry.
  • Represented a pharmaceutical company in a Federal Trade Commission investigation relating to the settlement of patent infringement litigation under the Hatch-Waxman Act.
  • Represented a major utility in insurance coverage litigation relating to environmental liabilities.
  • Advised a leading telecommunications company on antitrust issues in connection with a joint venture.
  • Represented a financial services company in a copyright and trade secrets litigation concerning computer software.

Previous Experience

  • Ms. Arens has worked as a writer and editor at two Washington-based political journals, Policy Review and The Public Interest.  She served as Managing Editor of The Public Interest from 2001 to 2003.

Honors and Rankings

  • Seymour A. Levy Memorial Award for the graduating student who has written the most outstanding note for the Annual Survey of American Law.

Pro Bono

  • Won acquittal of a criminal defendant after two-day jury trial on assault charges in Prince George’s County, Maryland.
  • Represented a criminal defendant in a petition for certiorari in the United States Supreme Court.
  • Secured release of two inmates in parole hearings before the United States Parole Commission.
  • Represents an Alabama death row inmate in federal habeas proceedings in the Northern District of Alabama.
  • Represented a defendant in a complex criminal appeal in the Sixth Circuit.
