David J. Shaw has represented clients in antitrust litigation, including against allegations of sham litigation, and government investigations. He advises clients on a range antitrust of matters, including exclusive dealing arrangements and contemplated mergers. He also routinely advises clients on federal and state campaign finance, lobbying disclosure, pay to play, and government ethics laws, and has represented clients in internal, congressional, and governmental investigations.
Representative Matters
- In re LIBOR-Based Financial Instruments Antitrust Litigation. Representing Citibank in MDL antitrust class actions pending in S.D.N.Y. alleging fixing of libor rates in violation of the antitrust laws, and other federal laws.
- In re Wellbutrin XL Antitrust Litigation. Successfully represented Valeant Pharmaceuticals International (formerly Biovail Corporation) in class action litigation consolidated in the Eastern District of Pennsylvania involving allegations of sham litigation. Obtained summary judgment on most claims leading to favorable settlement on remaining claim.
- Represent biopharmaceutical company in FTC investigation.
- Advised corporation on state campaign finance and lobbying disclosure laws.
- Advised trade association on federal campaign finance law.
Pro Bono
- Successfully represented Virginia home owner in lawsuit against mortgage modification fraudster. Lead counsel in bench trial in Virginia state court, obtaining $797,000 judgment, including $300,000 in punitive damages.
- Representing criminal defendant in Maryland death penalty trial.
- Representing Ohio public school in federal court in lawsuit brought by ACLU and Freedom From Religion Foundation concerning religious display.
- Malik v. District of Columbia. Student counsel with Georgetown's Appellate Litigation Clinic, appointed amicus curie to assist appellant. Briefed and orally argued appeal from summary judgment granted to District of Columbia and private prison against pro se prisoner in civil rights case. Won reversal of summary judgment and remand to district court in a published opinion.
