Derek Ludwin practices in Covington’s Washington, DC office, where he focuses on antitrust and corporate counseling matters.

Mr. Ludwin advises domestic and international clients on a wide variety of antitrust matters, including antitrust compliance and monitoring, potential acquisitions and other transactions, criminal and civil government investigations, and litigation.  He has particular experience in technology and licensing, telecommunications and media, transportation, healthcare, and sports matters.  Mr. Ludwin has represented clients in a broad array of government proceedings, including federal district and appellate matters.

Mr. Ludwin also advises clients on commercial issues, including international transactions, joint ventures, and disputes.

Representative Matters

  • Representation of leading electronics company as national counsel in multi-district, class action antitrust litigation.
  • Representation of major manufacturer in international price-fixing cartel investigation.  DOJ closed its grand jury investigation without action.
  • Representation of venture among US media companies in DOJ civil inquiry, which was closed without enforcement action.
  • Advice to OCP S.A. of Morocco in connection with joint venture and commercial supply arrangements, and in general corporate and governance matters.
  • Representation of National Football League in antitrust challenge to trademark licensing arrangements (American Needle v. NFL).
  • Representation of airline in class action antitrust litigation.
  • Representation of semiconductor manufacturer in antitrust licensing disputes.
  • Representation of pioneer pharmaceutical companies in antitrust litigation arising out of patent challenges by ANDA applicants.
