Daniel H. Kahn is an associate in the firm's Washington, DC office and a member of its Communications & Media and Privacy & Data Security practice groups. He counsels clients from across the media and electronic landscapes in compliance, transaction, litigation, and regulatory enforcement matters.

Mr. Kahn has expertise in a broad range of legal issues, including Federal Communications Commission regulation, privacy and consumer protection laws, intellectual property, and defamation and newsgathering issues.  He represents clients in litigation as well as policymaking and adjudicatory proceedings before the Federal Communications Commission, the Federal Trade Commission, and other federal and state regulatory agencies.  He also assists clients with transactional matters pertinent to his areas of expertise, including licensing agreements and telecommunications transactions.

Representative Matters

  • Advises and represents clients across industry sectors in the FCC’s implementation of the Twenty-First Century Communications and Video Accessibility Act of 2010, a landmark law creating new accessibility, closed captioning, and video description requirements for Internet services and equipment.
  • Counsels Web and software companies on applicability of broad range of federal and state privacy laws relating to cutting-edge software and online services.
  • Advises television clients on Emergency Alert System obligations, including the first EAS Nationwide Test and Common Alerting Protocol implementation.
  • Performed audit of remote data storage company’s US privacy practices.
  • Assists television reporters with respect to legal questions surrounding information gathering, surveillance, publication risks, and copyright issues.
  • Conducts due diligence and pursues necessary approvals of federal and state regulators in connection with telecommunications transactions.

Pro Bono

  • Advises non-profit organization on privacy issues involved in setting up cloud database containing program participant information.
  • Co-authored amicus brief on behalf of Center for Democracy and Technology supporting petition for certiorari before U.S. Supreme Court in Roberts v. Kauffman Racing Equipment, LLC, concerning the limits of personal jurisdiction as applied to speech on the Internet.
  • Drafted website privacy policies and terms of use for multiple non-profit organizations.
  • Reviews watchdog NGO white papers for libel and other publication risks.
