David Fink is an associate in the Brussels office.  His practice encompasses corporate compliance and legislative advocacy.  Mr. Fink regularly advises clients on the design, implementation and evaluation of global compliance programs and coordinates internal investigations.  He also works with clients on EU policy initiatives, particularly in the ICT area (data protection, network and information security, e-commerce, standards and interoperability).

Before joining Covington, Mr. Fink provided legal advice for several years on cross-border capital markets and M&A transactions.  He also worked as a journalist in Hungary.

Representative Matters

  • Conducting internal investigations in several countries concerning possible violations of the Foreign Corrupt Practices Act and local laws.
  • Advising and assisting companies on issues arising under the FCPA and other laws prohibiting bribery and related forms of corruption.
  • Drafting anti-corruption compliance procedures and related materials for European, US and Asian companies.
  • Designing a proactive program to reduce demands for facilitation payments during customs clearance.
  • Assessing the intermediary due diligence procedures of a major European company.
  • Providing advocacy support for a leading technology trade association.
  • Advising a major software company on regulatory and policy issues relating to cloud computing.
  • Representing ICT industry clients on security, data protection and IPR enforcement issues arising in the reform of the EU Telecommunications Framework.
