C. William Phillips is a co-chair of the firm's litigation group. Mr. Phillips' practice focuses on complex financial litigation, including M&A, securities, corporate control, commercial contract disputes, trade secrets, and bankruptcy.
Mr. Phillips has tried cases before judges and juries across the country. He has had substantial experience with complex corporate matters before the Delaware Chancery Court. Mr. Phillips also has extensive experience with preliminary and emergency injunctions, handling more than 15 in the last decade for clients either seeking or defending against injunctive relief in state and federal courts. The subjects of these proceedings have varied widely, including proxy fights, partnership disputes, joint venture disputes, non-competition clauses, and intellectual property challenges.
Representative Matters
- Represented Freddie Mac in defense against twenty securities and derivative class actions that were consolidated into a single multi-billion dollar lawsuit in New York federal court.
- Represented Bank One in its defense against claims of securities fraud and breach of fiduciary duty in connection with Bank One's role as co-placement agent and indenture trustee for $2 billion in asset-backed securities.
- Represented Overseas Media, a Russian language television network, in a contractual and intellectual property dispute with EchoStar.
- Represented Societe Generale in connection with claims and cross-claims arising from SG's purchase of Cowen & Co., a retail securities firm.
