Charles A. Miller is resident in our DC office and practices in the areas of Federal-State Programs, Health Care and Litigation, including Appellate and Supreme Court litigation. Mr. Miller consults and represents state and local health and welfare agencies, consulting firms, health care providers and public educational institutions on all aspects of federal law and policies governing Medicaid and other federally-funded programs, such as Medicare, State Children’s Health Insurance Programs, Temporary Assistance to Needy Families, Child Support Enforcement, Title IV-E Foster Care and Adoption Assistance, and Food Stamps. Mr. Miller’s practice embraces advice, assistance in pursuing administrative approvals, legislation, and court and administrative litigation. Mr. Miller has extensive appellate court experience, having appeared frequently before the United States Supreme Court, most federal courts of appeal, a number of federal district courts and various state courts throughout the country.

Representative Matters

  • Represented a coalition of states in concert with the National Governors Association in negotiating the federal statute regulations applicable to taxation of health care providers, and recently represented a group of states in overturning a billion dollar disallowance of federal Medicaid funds based on alleged impermissible taxes imposed on providers.
  • Prevailed on behalf of a large public university in a United States Supreme Court case confirming that university’s right to invoke sovereign immunity.
  • Represented several states in securing waivers from the federal Medicaid agency to undertake major health care program reforms and to restructure financing of their provider reimbursement systems.

Pro Bono

  • Counsels civic organizations devoted to enhancing development and improving government operations in the District of Columbia. 
  • Successfully secured judicial relief from discriminatory election laws in a southern state that led to substantially increased election of minority candidates to local government positions. 
  • Represented a coalition of citizens of the District of Columbia in litigation seeking to establish their constitutional right to participate in election of members of Congress.

  • Active participant and leader in various committees and civic organizations committed to improving education, enhancing the arts and encouraging community development.
