Ben Holland is a partner in the international arbitration practice group in the London office.  His practice focusses on energy-related disputes with particular emphasis on the energy, oil and gas, renewables, utilities and mining sectors.  His clients include oil and gas majors, super majors and power companies.

Mr. Holland specialises in handling multi-jurisdictional large-scale commercial dispute resolution for UK and international clients.  He has a particular focus on hydrocarbon pricing disputes under long-term international oil, gas, LNG and coal supply agreements and the impact of economic and regulatory change on the commercial balance under them.  His practice also focusses on disputes arising out of fluctuations in the price of crude oil and the consequential impact on the price of oil products, natural gas, LNG, coal and other commodities.

Mr. Holland also advises on disputes concerning the construction, operation and decommissioning of oil and gas production facilities and equipment, pipelines, onshore and offshore engineering, and power stations.  He also handles international trade and shipping disputes.

Recommended by leading publications, Mr. Holland is described as a ‘true energy disputes lawyer’ and a ‘really great operator’ (Chambers UK 2013), who ‘has got what it takes’ (Chambers UK 2012).

Representative Matters

  • Advising a leading state-owned oil company in a pricing dispute regarding a long-term crude oil supply contract with a sum in dispute in excess of US$16 billion.
  • Advising on three major price review arbitrations under the UNCITRAL rules relating to three long-term LNG contracts with a sum in dispute of approximately US$4.5 billion.
  • Advising an investment company in an LCIA arbitration in relation to oil investments in Iraq.
  • Advising an FPSO charterer in relation to cost and schedule overruns on a US$1.2 billion project offshore Brazil.
  • A major UK mining company in relation to a dispute with power station owners over the contract price under long-term supply agreements worth £100 million.
  • Advising on an arbitration under the rules of the Electricity Arbitration Association in relation to the introduction of the EU Emissions Trading Scheme on long-term power purchase agreements.
